Terms of Service & TCPA Compliance

1. Nature of Service (B2B Real Estate Data Intelligence)

ALXI operates exclusively as a Business-to-Business (B2B) real estate intelligence platform delivering public record deed monitoring and contact data feeds to licensed home service contractors. All records are compiled from public county courthouse deed filings, municipal property records, and third-party telecom databases. ALXI is not a telemarketing service and does not initiate consumer outreach on behalf of subscribers.

2. Telemarketing Compliance (TCPA & National DNC Registry)

The Subscriber (Contractor) assumes sole and independent legal responsibility for complying with all federal, state, and municipal regulations governing telemarketing, SMS communications, and consumer privacy, including:

• The Telephone Consumer Protection Act (TCPA, 47 U.S.C. § 227) and FCC telemarketing guidelines.
• The Telemarketing Sales Rule (TSR) and the FTC National Do Not Call (DNC) Registry.
• State calling time restrictions (e.g. 8:00 AM – 8:00 PM local time) and caller identification disclosures.

Subscriber agrees to independently screen and cross-reference provided phone numbers against the National DNC Registry and internal company opt-out records before initiating outbound voice or SMS marketing. ALXI accepts zero liability for subscriber marketing operations, automated dialer usage, or regulatory penalties.

3. Data Accuracy & 1-Click Replacement Credit System

While ALXI employs enterprise skip-tracing pipelines averaging an 80–85% verified mobile match rate, telecom assignments and public filings change dynamically. ALXI makes no warranty that 100% of contact numbers will be operational.

Remedy Limitation: Subscriber's sole and exclusive remedy for any disconnected phone line, wrong number, or inaccurate parcel record is limited to an instant replacement lead credit on the following morning's 6:00 AM drop by replying "REPLACE" to the daily lead email. ALXI shall not be liable for indirect, consequential, or lost revenue claims.

4. Territory Exclusivity & Non-Resale License

Active subscriptions grant the subscriber an exclusive, single-contractor territory license for their chosen trade and zip code(s). Subscriber agrees not to resell, distribute, share, or syndicate ALXI property data to competing contractors, sub-contractors, or marketing brokers.

5. Subscription Billing & Zero-Penalty Cancellation

Subscriptions renew automatically on a monthly schedule via PayPal Smart Subscriptions. Subscribers may adjust their assigned zip codes or cancel their subscription at any time with zero cancellation penalties or long-term contracts.
